An application has been submitted for the stopping up of a section of the highway at Treledan, Saltash, as shown coloured blue in plan 97833005 Rev.C. The Council is consulting on whether there are any objections to this area being stopped up
A stopping up application has been received under Section 117 of the Highways Act 1980 for the proposed stopping up of a section of the highway at Treledan, Saltash. The area coloured blue on plan 97833005 Rev.C has been subject to planning approval under which it now forms part of the new housing development. As the area was not stopped up under the Town and Country Planning Act 1990 the Council is now seeking to stop it up using their powers under the Highways Act 1980. The Council considers this is surplus to highway requirements and is therefore consulting wider users on their views prior to making an application to the court
The area is deemed to no longer be required as highway. If a stopping up order is made the highway rights will be extinguished and the maintenance responsibilities will revert to the landowner or adjacent properties
